CATALOG OF FEDERAL DOMESTIC ASSISTANCE

10.451:  Noninsured Crop Disaster Assistance

Popular Name:  NAP

Objectives:  To provide eligible producers of eligible crops with protection comparable to the catastrophic risk protection plan of crop insurance and to help reduce production risks faced by producers of crops for which catastrophic risk protection plan of crop insurance under the Federal Crop Insurance Act, as amended, is not available. The noninsured crop disaster assistance program reduces financial losses that occur when natural disaster cause a catastrophic loss of production or prevented planting of an eligible crop. Payment eligibility is based on an expected yield for the area and the producer's approved yield based on actual production history, or a transitional yield if sufficient production records are not available. Production for both the applicable area expected yield and the individual producer approved yield for the unit must fall below specified percentages in order to be eligible for payment under this part.

10.451 ELIGIBILITY REQUIREMENTS:

Applicant Eligibility:  Applicants must meet all of the following conditions as determined by the approving official: (1) May not have total annual gross revenue in excess of $2 million for the preceding tax year for which assistance is requested; (2) may not receive payments in excess of $100,000 per person per crop year; (3) must have suffered a greater than 50 percent loss of production and (a) for years 1996 through 1998 will receive assistance against the loss at 60 percent of the established average market price for the crop, (b) for crop years after 1998, will receive assistance against the loss at 55 percent of the established average market price for the crop; and (4) must choose whether to receive other program benefits or benefits under more than one program administered by the Secretary for the same crop loss. Applicants are not eligible for both.

Credentials/Documentation:  Applicants must certify: (1) Applicable crop acreage and crop production; (2) that annual gross revenue is not in excess of $2 million; (3) that provisions of highly erodible land and wetland conservation have not been violated; and (4) applicants do not have a controlled substance violation.

10.451 APPLICATION AND AWARD PROCESS:

Preapplication Coordination:  None. This program is excluded from coverage under E.O. 12372.

Application Procedure:  Applicants visit the county FSA office to report crop loss and make application for payment, to certify crop acreages and report crop production, and to certify program eligibility requirements.

Award Procedure:  None.

Deadlines:  (1) Applicants must file notice of crop loss within 15 calendar days after the date the disaster condition occurred or damage to the crop was obvious; (2) applicants must report crop acreage after the crop is planted and before the crop is harvested and comply with crop reporting dates established by each State Committee of the Farm Service Agency; and (3) applicants must report crop production by the immediately subsequent crop year acreage reporting date.

Range of Approval/Disapproval Time:  Approval is 90 days or less following area approval in most cases if complete information is furnished by the applicants.

Appeals:  Applicants may appeal to the county and State FSA committees and to the National Appeals Division.

Renewals:  None.

Criteria for Selecting Proposals:  None.

10.451 PROGRAM ACCOMPLISHMENTS:

Payments made under the Noninsured Crop Disaster Assistance Program in fiscal year 1999 totaled $1,005,077 for the 1996 crops, $5,259,740 for the 1997 crops, $47,032,824 for the 1998 crops and $631,980 for the 1999 crops as of September 30, 1999. Payments made under the Noninsured Crop Disaster Program in fiscal year 1999 totaled $9,688,594 ($31,767 for the 1996 crops; $1,963,424 for the 1997 crops; $2,942,498 for the 1998 crops; $4,733,841 for the 1999 crops, and $17,064 for the 2000 crops) as of January 31, 2000.

10.451 ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements:  Formula and matching requirements are not considered under this part.

Length and Time Phasing of Assistance:  Payment is made by check upon determining area production loss, unit production loss, and applicant eligibility.

Uses and Use Restrictions:  Basic program eligibility requirements include: (1) A geographic area within the continental United States that has suffered a greater than 35 percent loss of production of eligible crops because of damaging weather, including but not limited to drought, hail, excessive moisture, freeze, tornado, hurricane, excessive wind, or any combination thereof; or adverse natural occurrence such as earthquake, flood, volcanic eruption, or related condition, including but not limited to heat, insect infestation, or disease which occurs as a result of an adverse natural occurrence or damaging weather occurring prior to or during harvest that directly causes, accelerates, or exacerbates the destruction or deterioration of an eligible crop. An eligible area may be designated as (a) a county, (b) aggregated acreage that is at least 320,000 acres, or ( c) aggregated acreage with not less than $80 million average value for all crops produced annually; (2) minimum producer requirements are (a) for areas within the United States, at least 5 producers on separate and distinct farms of crops for which the NAP area has been designated, (b) for areas outside the United States, at least 10 producers of the crops for which the NAP area has been designated; (3) eligible crops are any commercial agricultural crop (excluding livestock and their by-products), commodity, or acreage of a commodity grown for food or fiber for which catastrophic coverage is not available. Additional eligible crops include, floriculture, ornamental nursery, Christmas tree crops, turf grass sod, seed crops, aquaculture (including ornamental fish), and industrial crops.

10.451 POST ASSISTANCE REQUIREMENTS:

Reports:  There are no reports due for post assistance requirements under this program.

Audits:  Recipients under this program are subject to audit by the Office of the Regional Inspector General, USDA.

Records:  Applicants shall retain financial books and records that permit verification of all transactions for at least 3 years following the end of the calendar year in which assistance is provided.
