14.406:  Non-Discrimination in the Community Development Block Grant Program (On the Basis of Race, Color, National Origin, Religion, or Sex)

Popular Name:  Section 109

Objectives:  Section 109 of Title I of the Housing and Community Development Act of 1974, as amended prohibits discrimination in Community Development Block Grant Programs on the basis of race, color, national origin, religion, or sex.

14.406 ELIGIBILITY REQUIREMENTS:

Applicant Eligibility:  Any persons believing he/she has been subjected to discriminatory action in a Title I program on the basis of race, color, national origin, religion, or sex may file a complaint with the Department of Housing and Urban Development. Complaints may also be filed on the behalf of a specific group or individual believed to have been subjected to discriminatory action prohibited by this part.

Beneficiary Eligibility:  Aggrieved individuals.

Credentials/Documentation:  None.

14.406 APPLICATION AND AWARD PROCESS:

Preapplication Coordination:  This program is excluded from coverage under E.O. 12372.

Application Procedure:  Complaints may be sent to any HUD Field Office Fair Housing Enforcement Center, Program Operations and Compliance Center or Headquarters. Complaints must be in writing.

Award Procedure:  None.

Deadlines:  Complaints should be received within 180 days of the date of the alleged act of discrimination. May be amended.

Range of Approval/Disapproval Time:  About 6 months.

Appeals:  Request for review within 30 days of preliminary "Letter of Finding". If new "material evidence" is submitted, case can be "re-opened".

Renewals:  Request for review within 30 days of preliminary "Letter of Finding". If new "material evidence" is submitted, case can be "re-opened".

Criteria for Selecting Proposals:  Not applicable.
