16.727:  Enforcing Underage Drinking Laws Program

Objectives:  To support and enhance efforts by States, in cooperation with local jurisdictions, to enforce underage drinking by prohibiting the sale of alcoholic beverages, or the consumption of alcoholic beverages by minors.

16.727 ELIGIBILITY REQUIREMENTS:

Applicant Eligibility:  To receive a Project Grant, applicant must detail a comprehensive approach to enforcing underage drinking laws and describe how the Federal funds will be used to contribute to the implementation of that comprehensive approach. States will be encouraged to link with ongoing public and private efforts (including those of foundations and national organizations). To receive a Block Grant, Governors and the Mayor of DC are each being asked to designate an agency to serve as the point of contact to apply for, receive, and administer the targeted grant funds. Training and technical assistance funds will be made available through a separate application process.

Beneficiary Eligibility:  States, territories, and the District of Columbia will be eligible to apply for discretionary funds through a separate application process.

Credentials/Documentation:  Each applicant applying for funds must submit a completed application, including signed assurances that it will comply with administrative requirements. In fiscal year 2000, Discretionary funds will be awarded to 10 States. These States have selected two to eight local jurisdictions in which to implement this initiative.

16.727 APPLICATION AND AWARD PROCESS:

Preapplication Coordination:  This program is eligible for coverage under E.O. 12372, "Intergovernmental Review of Federal Programs." An applicant should consult the office or official designated as the single point of contact in his or her State for more information on the process the State requires to be followed in applying for assistance, if the State has selected the program for review.

Application Procedure:  Applicants must submit completed Standard Form 424 and other information outlined in the Application Kit to the Office of Justice Programs, Office of Juvenile Justice and Delinquency Prevention. Each applicant must detail a comprehensive approach to enforcing underage drinking laws and describe how the Federal funds will be used to contribute to the implementation of that comprehensive approach. States are encouraged to link with ongoing public and private efforts (including law enforcement agencies and those of foundations and national organizations). The receipt, review, and analysis of applications will follow Office of Justice Programs policies and procedures for the administration of grant applications.

Award Procedure:  A letter with copies of the grant award is sent to the applicant agency upon approval by the Office of Justice Programs. One copy of the grant award must be signed by an authorized official and returned to the Office of Justice Programs. Local units of government will receive Enforcing Underage Drinking Laws funds through the applicant agency subgrant award process.

Deadlines:  Consult the Application Kit or contact the State Relations and Assistance Division, OJJDP (202) 307-5924, the Training and Technical Assistance Division, OJJDP (202) 307-5940, or the Special Emphasis Division for application deadlines.

Range of Approval/Disapproval Time:  Applications will generally be approved within 30 to 45 days of receipt of a complete application.

Appeals:  Hearings and appeal procedures will follow 28 CFR, Part 18, of the Department of Justice Regulations.

Renewals:  Renewals are subject to appropriations.

Criteria for Selecting Proposals:  Criteria is established by the Combating Underage Drinking Program Guideline of FY 1999 as established by the Office of Juvenile Justice and Delinquency Prevention.

Examples of Funded Projects:  The Training and Technical Assistance Division has the responsibility for administering training and technical assistance projects to support States and units of local government in addressing the 12 program purpose areas. In fiscal year 1998, 19 awards were made, for a total of $3,500,000. In fiscal year 2000, a continuation award was made to Pacific Institute for Research (PIRE), the national technical assistance provider.

16.727 RELATED PROGRAMS:

16.727 PROGRAM ACCOMPLISHMENTS:

Public Law 105-277, October 21, 1998, making appropriations for the Departments of Commerce, Justice and State, the Judiciary, and related agencies for the Fiscal Year ending September 30, 1999, and for other purposes (Appropriations Act) appropriated $25 million to the Office of Juvenile Justice and Delinquency Prevention. "Block" grants of $360,000 were to be made available to States and DC to build these types of approaches into a state strategy. In addition, $5 million was to support discretionary awards and $1,640,000 was awarded for training and technical assistance to support the programs. In response, OJJDP awarded each State and DC a $360,000 "block" grant to be administered by a governor-designated State agency for a total of $18,360,000. Ten States (California, Louisiana, Maryland, Michigan, Minnesota, New Mexico, Ohio, Pennsylvania and Wisconsin) and Puerto Rico won competitive discretionary awards to support the demonstration of the Combating Underage Drinking Program at the local level. Each State received up to $400,000. Puerto Rico received $25,000. A national evaluation was initiated through a discretionary grant of $499,878 to Wake Forest University. A demonstration program was initiated to develop a strategy for the Program in Indian Country through a $400,000 discretionary grant to Native American Connections, Inc., located in Phoenix, Arizona. A program model that addresses the enforcement of underage drinking laws for Indian Country is under development and will be piloted in four tribal sites. $60,000 was provided to Students Against Destructive Decisions (SADD) to demonstrate how youth can team with adult leadership in the community to enhance public awareness and education concerning the illegal sale of alcohol to minors. Their strategy includes encouraging vendors/retailers to comply with the underage drinking laws and encouraging law enforcement to enforce the laws. In fiscal year 2000, a continuation award was made for a National Technical Assistance provider. In addition, OJJDP solicited applications for a new round of awards and up to ten new sites will receive awards in early fiscal year 2000.

16.727 ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements:  In fiscal year 2000 a total of $25 million was appropriated and allocated, as in fiscal year 1999 to continue supporting the Enforcing Underage Drinking Laws Program. These funds will be disbursed through assistance awards of $360,000 to each State and DC; discretionary funds in the amount of $5 million; and $1,640,000 of training and technical assistance funds.

Length and Time Phasing of Assistance:  Awards are made for 12 to 24 months.

Uses and Use Restrictions:  In fiscal year 2000, a total of $25 million was awarded as follows: Funds were dispersed in the amount of $360,000 to each State and DC to support and enhance efforts by States, in cooperation with local jurisdictions, to prohibit the sale of alcoholic beverages to, or consumption of alcoholic beverages by minors. For purposes of this initiative, minors are defined as individuals under 21 years of age. These funds cannot be used to supplant existing programs and activities. (Supplanting means to deliberately reduce State or local funds because of the existence of Federal funds.) Funds in the amount of $5 million will be competitively awarded to State agencies receiving block grants for the purpose of supporting selecting, local jurisdiction programs in their State. The programs will implement the comprehensive approach to the enforcement of laws pertaining to underage alcohol purchase, possession, and use. Funds in the amount of $1,640,000 will be made available through a separate application for training and technical assistance to enforce State laws prohibiting the sale of alcoholic beverages to minors and to prevent the purchase or consumption of alcoholic beverages by minors.

16.727 POST ASSISTANCE REQUIREMENTS:

Reports:  Quarterly financial and semiannual progress reports are required.

Audits:  All organizations that expend financial assistance of $300,000 or more in any fiscal year must have a single audit for that year in accordance with OMB Circular No. A-133, as described in OJP's Financial Guide, Chapter 19.

Records:  In accordance with the requirement set forth in 28 CFR, Parts 66 and 70, recipients must maintain all financial reports and other supporting documents pertinent to the award for at least 3 years following the close of the most recent audit.
