17.255: Workforce Investment Act

Applicant Eligibility: Under Title I formula funded activities, Section 126, 131 of WIA identify the Governor as the recipient of youth, adult and dislocated worker training activities funds. For Title I Native American programs, eligibility applicants include Indian tribes, tribal organizations, Alaska native entities, Indian-controlled organizations serving Indians, or Native Hawaiian organizations, as identified by Section 166 of WIA. For Title I Migrant and Seasonal Farm worker programs, to be eligible to receive a grant or enter into a contract, an entity shall have an understanding of the problems of eligible migrant and seasonal farm workers (including dependants), a familiarity with the area to be served, and the ability to demonstrate a capacity to administer effectively a diversified program of workforce investment activities (including youth activities) and related assistance for eligible migrant and seasonal farm workers, as identified by Section 167 of WIA. For Title I Veterans' workforce investment programs, public agencies, and private non-profit organizations including recipients of Federal Assistance under other provisions of Title I, as identified by 168 of WIA. For Title I Youth Opportunity grants, local workforce investment boards, as identified by Section 169 of WIA. Under Section 116 of the Act, Governors are responsible, for designating local workforce investment areas within the State and approval of comprehensive 5-year local plans.
Beneficiary Eligibility: (Title I) Youth not less then 14 years of age and not more than age 21 identified as low-income and with at least one or more of the following attributes: Deficient in basic literacy skills; a school dropout; homeless, a runaway, or a foster child; pregnant or a parent; an offender; or a individual who requires additional assistance to complete a educational program, or to secure and hold employment. Not less than 30 percent of the local workforce investment area's youth activities funds must be used to provide services to out-of-school youth and not more than 5 percent may be individuals who do not meet the minimum income criteria, but are within one or more of the following categories: Individuals who are school dropouts, basic skills deficient; pregnant or parenting; offenders; other eligible youth who face serious barriers to employment as identified by the local board; individuals with disabilities (including learning disabilities) and individuals with educational attainment that is one or more grade levels below the grade level appropriate to the age of the individuals. Under Title I Adult and Dislocated Worker Training Activities, core services must be universally accessible to adults and dislocated workers through local One-Stop Career Centers. Intensive services may be provided to adults and dislocated workers who are unemployed and unable to obtain employment through core, if the One-Stop operator determines that the individual is in need of more intensive services in order to obtain employment. Employed adults and dislocated workers who are determine by the One-Stop operator to be in need of intensive services in order to obtain or retain employment that allows for self-sufficiency are also eligible to receive intensive services. Individuals who have met the eligibility requirements for intensive service, and are unable to obtain or retain the eligibility requirements for intensive service, and are unable to obtain or retain employment through intensive services may receive training services. Title I National Programs are targeted to include: Native Americans (Section 166); Migrant and Seasonal Farm workers (Section 167); Veterans (Section 168); and Youth 14-21 years-old residing in defined target areas within an Empowerment Zone, Enterprise community or other high-poverty areas defined by the Governor (Section 169).
Credentials/Documentation: In order to establish a continuing relationship under the Act the Governor and Secretary of Labor shall consist of a statement assuring that the State shall comply with the Workforce Investment Act and the applicable rules and regulations.
Preapplication Coordination: This program is eligible for coverage under E.O. 12372, intergovernmental Review of Federal Programs. An applicant should consult the office or official designated as the single point of contact in his or her State for more information on the process the State requires to followed in applying for assistance, if the State has selected the program for review.
Application Procedure: For Title I formula grants, the Governor submits a State Plan to the Employment and Training Administration, Raymond Bramucci, Assistant Secretary, Department of Labor, Employment and Training Administration, 200 Constitution Ave., NW., Room S-2307, Washington, DC 20210. This program is excluded from coverage under OMB Circular No. A-110. Award Procedure: Title I Youth and Adult Dislocated Worker training activities funds are allotted by statutory formula to States by the National Office of the Employment and Training Administration. Title I National Program grants are awarded on a competitive basis.

Range of Approval/Disapproval Time: A State Plan submitted to the Secretary by a Governor shall be considered to be approved by the Secretary at the end of the 90-day period beginning on the day the Secretary receives the plan, unless the Secretary makes a written determination, during the 90-day period, that the plan is inconsistent with the provisions of Title I. For National program grants and contracts, awards will be made in a timely manner and based on the overall responsiveness of applicants to the solicitation grant announcement or request for proposal, as well as what is most advantageous to the Department of Labor.

Formula and Matching Requirements: Title I Youth Activities funds Adult and Dislocated Worker Training and Employment Activities; funds are allocated to States under the formula described in the act. For Title I national program funds, the Secretary shall, on a competitive basis, make grants to or enter into contracts or cooperative agreements.
Length and Time Phasing of Assistance: Formula funds are allotted based on unemployment statistics available for the most recent 12 months.
Uses and Use Restrictions: Title I of the Act authorizes the new Workforce Investment System and establishes the State Workforce Investment Boards with oversight responsibility by the Governors for the local workforce investment boards; establishes the design and required partnerships of the local One-Stop Career Centers and the process for which eligible providers of training and youth activities are identified. Also authorized are the use of the funds for youth activities, adult and dislocated worker employment and training activities; establishment of the local youth council, whose role is to ensure the provision and coordination of workforce investment activities to low income youth in the local area; provides for three levels of services: core services; intensive services; and training. Individuals may access training services through individual training accounts(ITA's). The Act also authorizes a number of National programs Job Corps, Native American, and migrant and Seasonal Farm worker programs; Veterans' Workforce Investment programs; Youth Opportunity grants for high-poverty areas; technical assistance efforts to States and local areas; demonstration, pilot, and other special National projects; program evaluations; and National Emergency grants. Title II amends the Wagner-Peyser Act to require that ES/Job Service become part to the One-Stop system, provides linkages for Trade Adjustment Assistance and NAFTA-TAA; and Title V establishes States unified planning and sets forth definitions for indicators of performance and State performance incentive grants.
Reports: Reporting requirements as specified by the Secretary in accordance with 20 CFR 667.300.
Audits: Audit of the States and Workforce Investment Areas will be conducted in accordance with 20 CFR 667.200.
Records: States are required to maintain adequate records in accordance with 29 CFR 95 and 97.
