83.549:  Chemical Stockpile Emergency Preparedness Program

Popular Name:  CSEPP

Objectives:  To enhance emergency preparedness capabilities of the States and local communities at each of the eight chemical agent stockpile storage facilities. The purpose of the program is to assist States and local communities in efforts to improve their capacity to plan for and respond to accidents associated with the storage and ultimate disposal of chemical warfare materials.

83.549 ELIGIBILITY REQUIREMENTS:

Applicant Eligibility:  Applications are accepted from Alabama, Arkansas, Colorado, Illinois, Indiana, Kentucky, Maryland, Oregon, Utah, and Washington. The eligible States are where the U.S. Army stockpiles unitary chemical warfare agent as bulk chemicals and munitions. Local governments and Indian Tribes are eligible to participate as subgrantees under their State's application.

Beneficiary Eligibility:  State, local, and general public.

Credentials/Documentation:  The budget worksheets used for CSEPP must be included in the official application package. These worksheets will be used for budget analysis by FEMA.

83.549 APPLICATION AND AWARD PROCESS:

Preapplication Coordination:  A preapplication meeting with the FEMA Regional Offices and their respective States usually occurs to discuss the application and draft work plan. Technical assistance is available for application preparation from the FEMA Regional Office. This program is excluded from coverage under E.O. 12372.

Application Procedure:  The application for assistance shall be prepared in accordance with the FEMA Application Module for Financial and Technical Assistance under the Performance Partnership Agreement. Applicants are provided annual cooperative agreement guidance. FEMA's Office of Financial Management has developed a set of instructions on applying for grants under all FEMA programs. The instructions are entitled "Application Module for Financial and Technical Assistance under Performance Partnership Agreements" and are fully consistent with all applicable Office of Management and Budget circulars and the Uniform Administrative Requirements for Grants and Cooperative Agreements to State and Local Governments. There is also a Cooperative Agreement Automated Application that the States can use on a personal computer to greatly facilitate the process of developing their annual application if they so choose. As early as possible in each fiscal year, FEMA provides the State a planning estimate of funding for all grant programs in the next fiscal year based on the level of funding being requested in the President's budget. FEMA regional personnel work directly with the States on the development of their applications, especially their program narratives. The program narratives are developed by the States, are reviewed by FEMA regional personnel, and eventually are finalized in negotiations between the States and FEMA Regions.

Award Procedure:  When FEMA receives its annual appropriation from the Department of the Army, CSEPP funds are allocated among the States. The FEMA Regions notify the States of their allocations, any necessary adjustment to the program narratives are agreed upon, and award documents are prepared and signed by officials of the State and the FEMA Region. States notify local participants of the amounts of their grants.

Deadlines:  All eligible applicants are notified of target dates and any applicable deadlines in FEMA's annual cooperative agreement guidance package.

Range of Approval/Disapproval Time:  About 90 days from the date of application submissions. Preliminary budget decision advisory letters are distributed before September 30. Actual awards are based on Congressional passage and Presidential approval of the Fiscal Year Appropriations Acts.

Appeals:  May be submitted in writing by the authorized State official to the FEMA Regional Director.

Renewals:  A new application is required for each Federal fiscal year.

Criteria for Selecting Proposals:  Applications are reviewed to assure that the program narrative is consistent with the negotiated Performance Partnership Agreement and that the specific outcomes identified are in accordance with the CSEPP goals, objectives, and established program policies.

Examples of Funded Projects:  None.

Range and Average of Financial Assistance:  $60,000 to $4,000,000; $2,000,000.

83.549 PROGRAM ACCOMPLISHMENTS:

Installed operational siren systems, completed demographic surveys of immediate response zones, improved emergency operating centers, procured dedicated radio and phone systems, developed training courses and trained over 13,000 people, enhanced and conducted exercises, expanded public education and public affairs outreach programs, and updated site emergency plans and operating procedures at all sites.

83.549 ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements:  None.

Length and Time Phasing of Assistance:  None.

Uses and Use Restrictions:  In keeping with the intent of the Congressional appropriations, CSEPP funds are to be utilized for effective emergency management capabilities at the 10 affected States and local communities surrounding the eight Army stockpile locations. CSEPP funds may not be used as a substitute for other mandated, unfunded programs required for existing needs or by other laws. CSEPP funds may not be used to supplant other forms of emergency management funding. CSEPP funds may not be commingled with other, non-CSEPP funds.

83.549 POST ASSISTANCE REQUIREMENTS:

Reports:  Financial and performance reports must be submitted as required by OMB Circular No. A-102 and by 44 CFR 13.40 and 44 CFR 13.41. All eligible State participants have been provided a manual entitled "Outlays, Performance Reporting, Budget Deviations, Property Management and Close-Out Module for Financial and Technical Assistance under Performance Partnership Agreements" prepared by the FEMA Office of Financial Management.

Audits:  Each State is required to have an audit conducted in accordance with the Single Audit Act of 1984, Public Law 98-502, and the Single Audit Act Amendments of 1996, Public Law 104-156. Implementation requirements of this law are established by OMB Circular No. A-133. FEMA's implementing regulations appear at 44 CFR Parts 13 and 14. For fiscal years beginning after June 30, 1996, applicants should consult the Single Audit Act Amendments of 1996, Public Law 104-156 and OMB Circular No. A-133 for changes which are not yet reflected in 44 CFR Parts 13 and 14. OMB Circular No. A-133 provisions have been published in the Federal Register on August 29, 1997. In accordance with the provisions of OMB Circular No. A-133, "Audits of States, Local Governments, and Non-profit Organizations," nonfederal entities that expend financial assistance of $300,000 or more within their fiscal year shall have an audit made for that year. Nonfederal entities that expend less than $300,000 in Federal awards are exempt from Federal audit requirements for that year, except as noted in the Single Audit Act Amendments of 1996 and OMB Circular A-133, but the records must be available for review or audit.

Records:  All pertinent records relating to Federal financial assistance must be maintained and retained for a period of 3 years, as required and defined by OMB Circular No. A-102 and 44 CFR 13.42.
