CATALOG OF FEDERAL DOMESTIC ASSISTANCE

83.552:  Emergency Management Performance Grants

Popular Name:  EMPG

Objectives:  To encourage the development of comprehensive emergency management, including for terrorism consequence management, at the State and local level and to improve emergency planning, preparedness, mitigation, response, and recovery capabilities. By combining several funding streams into a consolidated Emergency Management Performance Grant (EMPG), FEMA's purpose is to ensure that recipients have the flexibility necessary to achieve measurable results in key functional areas of emergency management. Incorporated into EMPG are the following: 83.011, Hazardous Materials Training Program for Impplementation of the Superfund Amendment and Reauthorization Act (SARA) of 1986; 83.505, State Disaster Preparedness Grants; 83.534, Emergency Management: State and Local Assistance; and 83.535, Mitigation Assistance. Indian tribal governments must still apply under 83.011. This flexibility will be achieved within the standard grant administration process. The 13 key functional areas of emergency management are: Laws and Authorities; Hazard Identification and Risk Assessment; Hazard Management; Resource Management; Planning; Direction, Control, and Coordination; Communications and Warning; Operations and Procedures; Logistics and Facilities; Training; Exercises; Public Education and Information; and Finance and Administration.

83.552 ELIGIBILITY REQUIREMENTS:

Applicant Eligibility:  All States are eligible (including the District of Columbia and territories and possessions of the United States).

Beneficiary Eligibility:  Funding under this program is ultimately used by emergency management organizations and programs of States, the District of Columbia, territories and possessions of the Unites States, and local governments.

Credentials/Documentation:  None.

83.552 APPLICATION AND AWARD PROCESS:

Preapplication Coordination:  This program is eligible for coverage under E.O. 12372, "Intergovernmental Review of Federal Programs." An applicant should consult the office or official designated as the single point of contact in his or her State for more information on the process the State requires to be followed in applying for assistance, if the State has selected the program for review. Technical assistance is available for application preparation from the FEMA Regional Office.

Application Procedure:  All eligible applicants are provided annual guidance on EMPGs. FEMA's Office of Financial Management has developed instructions for grants management, including for applying for grants under all FEMA programs, and has provided them to eligible applicants for EMPGs. The instructions are fully consistent with all applicable Office of Management and Budget circulars and the Uniform Administrative Requirements for Grants and Cooperative Agreements to State and Local Governments (the Common Rule) which FEMA has implemented as 44 CFR 13. As early as possible in each fiscal year, FEMA provides the State a planning estimate of funding for EMPGs for the next fiscal year based on the level of funding requested in the President's Budget.

Award Procedure:  FEMA Regional Directors make final decisions to approve grants to the States and notify States of their awards.

Deadlines:  All eligible applicants will be notified of target dates and any applicable deadlines by way of the annual EMPG guidance package.

Range of Approval/Disapproval Time:  Within 60 days of receipt of formal application unless otherwise specified by FEMA in writing.

Appeals:  None.

Renewals:  A new application is required for each Federal fiscal year.

Criteria for Selecting Proposals:  State objectives for all-hazards risk and capability assessment, planning, mitigation, and preparedness activities, including terrorism-related activities. State-developed workplans will have to describe goals and objectives, results and benefits expected, and quantifiable projections of the program and accomplishments to be achieved. Performance measures will have to be identified and agreed upon by FEMA Regional Offices.

Range and Average of Financial Assistance:  $50,000 to $9,000,000; $2,000,000.

83.552 ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements:  This program has no statutory formula. For each eligible State and Territory, a target allocation is derived from the combined target allocations of the six programs being consolidated into the EMPG. A consolidated matching requirement is calculated for each State and Territory based on statutory guidelines. FEMA administers cost sharing requirements according to the Common Rule, 44 CFR 13.24.

Length and Time Phasing of Assistance:  The funding period for assistance under EMPGs is the Federal fiscal year for which the funds are appropriated. As required by 44 CFR 13.23 and appropriations law, all funds must be legally obligated by the end of the fiscal year. Any necessary changes to the scope of the grant may be made up to, but not after, the end of the fiscal year. EMPG funds are obligated to the States and made available through the Department of Health and Human Services' SMARTLINK System. States are required to initiate requests for funds as close as administratively feasible to the actual disbursements for program costs.

Uses and Use Restrictions:  EMPGs may be used for necessary and reasonable expenses to accomplish program purposes consistent with statutory authorization.

83.552 POST ASSISTANCE REQUIREMENTS:

Reports:  Financial and performance reports must be submitted as required by OMB Circular No. A-102, 44 CFR 13.40, and 44 CFR 13.41. Quarterly reports are due 30 days after the end of each quarter, and final reports are due 90 days after the expiration of termination of grant support. All eligible State recipients have been provided the instructions for grants management developed by FEMA's Office of Financial Management.

Audits:  In accordance with the provisions of OMB Circular No. A-133 (Revised June 24, 1997), "Audits of States, Local Governments, and Non-Profit Organizations," nonfederal entities that receive financial assistance of $300,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that spend less than $300,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in Circular No. A-133.

Records:  All pertinent records relating to Federal financial assistance must be maintained and retained for a period of 3 years, as required and defined by OMB Circular No. A-102 and 44 CFR 13.42.
