84.040:  Impact Aid: Facilities Maintenance

Objectives:  To maintain school facilities owned by the Department of Education and operated by local educational agencies (LEAs), and to transfer those facilities to the LEAs, where appropriate.

84.040 ELIGIBILITY REQUIREMENTS:

Applicant Eligibility:  LEAs that operate school facilities owned by the Department of Education.

Beneficiary Eligibility:  Public elementary and secondary school children will benefit.

Credentials/Documentation:  Costs will be determined in accordance with OMB Circular No. A-87 for State and local governments.

84.040 APPLICATION AND AWARD PROCESS:

Preapplication Coordination:  Contact the Program Office for information. This program is excluded from coverage under E.O. 12372.

Application Procedure:  Contact the program office for information.

Award Procedure:  The Department of Education makes final decisions to fund projects.

Deadlines:  None.

Range of Approval/Disapproval Time:  Not applicable.

Appeals:  None.

Renewals:  Approved construction projects may be revised during construction, subject to appropriate approvals.

Criteria for Selecting Proposals:  Emergency repairs are funded as needed. Priority for more extensive projects is given to LEAs that agree to accept transfer of the school facility.

Examples of Funded Projects:  Additions of classrooms to existing buildings. Repairs of schools to provide access for the disabled and to ensure the safety of building users. Construction of a new school to replace three outdated facilities on a military base.

84.040 PROGRAM ACCOMPLISHMENTS:

Emergency repairs are made to schools with funds from this program. Some facilities are improved to the extent that LEAs accept ownership.

Authorization:  Elementary and Secondary Education Act of 1965, Title VIII, Section 8008, as amended.

Regulations, Guidelines, and Literature:  Regulations are published at 34 CFR 222.

84.040 ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements:  Not applicable.

Length and Time Phasing of Assistance:  The length and terms of an award will be established prior to the award.

Uses and Use Restrictions:  To maintain federally owned school facilities and restore or improve them where appropriate to enable an LEA to accept ownership. The Department directly oversees construction projects, unless the LEA has agreed to accept transfer of the facility, in which case funds may be provided to the LEA to complete the project after the transfer.

84.040 POST ASSISTANCE REQUIREMENTS:

Reports:  In accordance with OMB Circular No. A-102 (Attachments H and I) and Education Department General Administrative Regulations (EDGAR) for direct project grant and contract programs, Part 100a, Subpart F. See 34 CFR 74, Subpart H, Standards for Grantees Financial Management Systems.

Audits:  In accordance with the provisions of OMB Circular No. A-133 (Revised, June 24, 1997), "Audits of States, Local Governments, and Non-Profit Organizations," nonfederal entities that receive financial assistance of $300,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that expend less than $300,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in Circular No. A-133.
