93.582:  Mitigation of Environmental Impacts to Indian Lands Due to Department of Defense Activities

Objectives:  To provide financial assistance to American Indian tribes and Alaska Native villages to mitigate environmental impacts to their lands due to Department of Defense activities by assisting the tribes and villages in the planning, development and implementation of programs for such mitigation.

93.582 ELIGIBILITY REQUIREMENTS:

Applicant Eligibility:  The following organizations are eligible to apply: Federally-recognized Indian tribes; incorporated non-Federally-recognized and State-recognized Indian tribes; Alaska Native villages, tribes or tribal governing bodies (IRA or traditional councils) as recognized by the Bureau of Indian Affairs in the Federal Register Notice dated October 21, 1993; nonprofit Alaska Native Regional Associations and/or Corporations with village-specific projects; nonprofit Native organizations in Alaska with village-specific projects; other tribal or village organizations or consortia of Indian tribes.

Beneficiary Eligibility:  American Indians and Alaska Natives will benefit.

Credentials/Documentation:  Not applicable.

93.582 APPLICATION AND AWARD PROCESS:

Preapplication Coordination:  None. This program is excluded from coverage under E.O. 12372.

Application Procedure:  Application Procedure: Information regarding the availability of grants funds will be published from time to time in the Federal Register as Programs Announcements, which will provide details on programs objectives for which applications are being solicited and other applications requirements. The Administration for Native Americans will provide each applicant with the appropriate forms for the application for Federal Assistance and instructions for applying for grants from Administration for Native Americans programs. Applications should be submitted to Administration for Children and Families, Division of Discretionary Grants, Mail Stop 6C-462, 370 L'Enfant Promenade, SW., Washington, DC 20447.

Award Procedure:  All funds are awarded directly to the grantees.

Deadlines:  Each program announcement specifies the due dates for submission of application.

Range of Approval/Disapproval Time:  Applicants will receive notice of approval/disapproval about 120 days after receipt of application.

Appeals:  Appeals are processed in accordance with HHS regulations in 45 CFR, Part 16.

Renewals:  Not applicable.

Criteria for Selecting Proposals:  Specific criteria for selecting proposals for funding are stated in each program announcement. In general, proposals are judged on the basis of relevance to program objectives as stated in the program announcement, projects viability, community support, reasonable cost estimates, and qualifications of applicant organization and personnel.

Examples of Funded Projects:  None.

Range and Average of Financial Assistance:  For Tribal Grants the estimated range is from $50,000 to $1,000,000.

93.582 PROGRAM ACCOMPLISHMENTS:

In fiscal year 1999, ANA awarded six new grants for projects which cover a wide range of mitigation efforts to assist Indian tribes and Alaska Native villages in the planning, development and implementation of environmental mitigation programs. It is anticipated that four grants will be awarded in fiscal year 2000 and two grants in fiscal year 2001.

Regulations, Guidelines, and Literature:  Regulations are published in 45 CFR 1336.

93.582 ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements:  This program has no statutory formula for distribution of funds. A matching share of 5 percent is required unless waived in accordance with criteria which are also published in 45 CFR, Part 1336.50.

Length and Time Phasing of Assistance:  Grantees may apply for competitive continuation support within a project period of 1 to 3 years.

Uses and Use Restrictions:  Funds may be used to support one or more of the following phases of mitigation work: Phase I: Research and planning to identify environmental impacts to tribal and village lands due to Department of Defense activities; Phase II: Examination of alternative approaches for mitigation of impacts identified in Phase 1; Phase III: Development of a comprehensive plan for conducting all aspects of mitigation actions; and Phase IV: Implementation of the mitigation plan.

93.582 POST ASSISTANCE REQUIREMENTS:

Reports:  Semi-Annual Financial Status Reports, Reports of Federal Cash Transactions, Project Progress Reports, and an Annual Evaluation Reports are required.

Audits:  Audits are conducted in accordance with the requirements in 45 CFR 74 and 92.

Records:  Financial records, supporting documents and all other related records pertinent to ANA grants must be maintained for a period of 3 years, or if audit findings have not been resolved, records shall be retained until resolution of the audit findings.
